We have received a Special Report on Legal Decisions with regard to tree failure from Landscape Planning. The report was produced following a spate of legal decisions and news stories associated with tree failure, tree works and landowner duties.


This Special Report looks at the stories, decisions, the nature of the landowners, their relative competencies and how the Courts considered the issues. At a time when budgets are being squeezed there is still a need to work within the legal and technical-professional framework, and to be clear about what the risks are and what is a sensible and proportionate approach.
The Courts have repeatedly made clear their position on what represents good practice and what is the basis for sensible decision making by corporate landowners.
